Alternative Dispute Resolutions (ADR)

Chartis’ Alternative Dispute Resolution Program (ADR) for workers’ compensation claims provides a swift, non-adversarial and cost-efficient solution to resolve work-related injury claims for insureds and their union employees.

A number of states have adopted statutes that enable special ADR Programs to resolve workers’ compensation claims instead of using the state workers’ compensation process. The ADR Program is designed to deliver workers’ compensation benefits faster, manage expenses and contain costs associated with claims.

  • Collectively Bargained Program Components
    –  In-network medical management program.
    –  Nurse Practitioner.
    –  Ombudsman or Facilitator who serves as a guide for entitled benefits and the available 
        resolution process.
    –  Informal mediation proceedings to resolve disputes.
    –  Arbitration to settle issues unable to be resolved through mediation.

  • Program Requirements
    -  The insured or the work performed by insured must be in a state that allows ADR Programs.
    -  Participation may be limited to the construction industry in certain states in accordance with
       state statutes. Other state statutes are broader and permit participation from other unionized
       industries.
    -  The Insured and its workers are subject to a collective bargaining agreement.
    -  Chartis must be an approved ADR carrier for the particular program or trade association.
    -  Minimum premium subject to underwriting requirements.

Thirteen non-monopolistic states have adopted legislation permitting the use of ADR to resolve workers’ compensation claims in lieu of state administrative proceedings:

    This program is administered by a joint labor-management trust called the Basic Crafts Workers’ Compensation Benefits Trust Fund.  It applies to any member whose employer chooses to sign on to the Basic Crafts Program.

  • Ironworkers Workers' Compensation Program [California]

    In an effort to increase safety performance and prevent job site injuries, the Ironworkers Workers’ Compensation Trust Fund has created a safety program policy for contractors who elect to participate in this collectively bargained workers' compensation program.

  • National Electrical Contractors Association (NECA) West [California]

    The National Electrical Contractors Association (NECA) West Alternative Dispute Resolution (ADR) program is the core insurance program for its members. The NECA West ADR program is the only ADR program endorsed by both the IBEW and NECA, and is approved by the State of California.

  • Operating Engineers Workers' Compensation Trust [California]

    Volunteer-led and governed by its members, SCCA has served the union heavy construction industry since 1974. Membership is open to contractors signatory with the Operating Engineers, Laborers, Cement Masons, Ironworkers, Carpenters or Construction Teamsters. Affiliate memberships are also available.

  • Carpenters-Contractors [California]

    The Carpenters-Contractors Workers’ Compensation Trust for Southern California is a collectively bargained “carve-out” program from the California state system.  It is designed exclusively for the use of our Carpenter-Contractor members and their employees. 

  • Union Construction Workers' Compensation Program (UCWCP) [Minnesota]

    In 1995, the Minnesota Legislature passed a law that allows unions and signatory employers to create their own method of administering workers' compensation benefits. A Board of Trustees was created in 1996 with balanced representation of union leaders and contractors. The Trustees asked Wilson-McShane Corporation to administer the Union Construction Workers’ Compensation Program, an alternative program to fit the needs of the construction industry. The Trustees approve the rules, procedures, physicians and others who make up the Union Construction Workers' Compensation Program.

  • Negotiated Workers' Compensation Insurance Program (NWCIP) [Florida]

    The NWCIP is labor and management coming together to create a more efficient, less adversarial and less costly workers’ compensation system. The Negotiated Workers’ Compensation Insurance Program (NWCIP) is the joint response of labor and management to Chapter 440.211, F.S. This statutory provision allows labor and employers acting under a collective bargaining agreement to use the strength of the collective bargaining environment to customize portions of the statutory Workers’ Compensation program.
