IDL Max®

IDL MAX® is “Side A” excess coverage enhanced with Difference In Conditions (DIC) to provide broad protection for directors of financial institutions in non-indemnifiable claims.  The non-rescindable policy makes first-dollar coverage available for independent directors in certain non-indemnifiable claims in which their traditional D&O policy does not respond due to (1) threatened or actual rescission of the underlying insurance policies, (2) wrongful refusal and/or financial inability of the underlying carriers to indemnify the insured persons, (3) denial of coverage by underlying carriers due to terms and conditions not contained in the more favorable IDL MAX® policy, or (4) underlying insurance policies do not pay because they are alleged to be part of the debtor’s bankruptcy estate.
