Maximum A-Side Excess® (MAX)

Maximum A-Side Excess® (MAX) is “Side A” excess coverage enhanced with Difference In Conditions (DIC) to provide expansive protection for directors and officers of financial institutions in non-indentifiable claims.  The non-rescindable policy makes first-dollar coverage available for both independent executives and “insiders” in certain non-indemnifiable claims in which their traditional excess policy does not respond due to (1) threatened or actual rescission of the underlying insurance policies, (2) wrongful refusal and/or financial inability of the underlying carriers to indemnify the insured persons, and (3) denial of coverage by underlying carriers due to terms and conditions inconsistent with MAX.

  • Once triggered, the policy pays on a Side A basis even if the insured’s company is obligated to indemnify but fails to do so
